18. Final provisions

a) Any changes or supplements to the this contract must be made in writing.  The requirement of such documents to be in writing does not apply to consumers as defined in the Austrian Consumer Protection Act (KSchG) . The contract shall be governed by Austrian law. However, the optional reference standards of international private law and the provisions of the CISG shall not be applied.
b) The place of performance for any and all deliveries, performance and payments shall be Vienna, even if the parties to the contract agree to hand over the purchase object in another location.
c) The place of jurisdiction for any disputes arising from this contract shall be the competent court in Wien Innere Stadt. For charges brought against consumers within the meaning of the KSchG the place of jurisdiction shall be the court at the place of residence, the habitual place of abode or the place of employment pursuant to Section 14 KSchG.
d) Should a provision of this contract be or become void or inadmissible, this shall not affect the validity of the remaining provisions. The invalid or inadmissible provision shall be replaced by a provision which comes as close as possible to the economic purpose of the invalid or inadmissible provision. This also applies to loopholes. With regard to consumers as defined by the KSchG the parties shall agree on a valid provision which substitutes the invalid one and comes as close as possible to the economic purpose intended by the parties with the deficient provision.
e) The client shall inform us of any name or address changes without delay. If no notification of a change in data is submitted, any documents shall be deemed to have been received by the client at the point when they were sent to the address most recently indicated by the client. If the client requests that a new invoice be issued in the case where a name change has not been submitted promptly, we will do our best to fulfil this request; however, this in no way affects the due date of the original invoice.
f) Headings in these General Terms and Conditions are used only for structural purposes; they do not, however, limit or restrict the individual provisions.
